How the Courts Determine Child Support Orders

Similar to child custody agreements, Texas courts encourage parents to work together to achieve an amicable agreement. When this is not possible, they will intervene and impose a child support order. When handing down child support orders, the courts are guided by the Texas Family Code. They consider a variety of factors including the custody arrangement, both parents’ income, and any special expenses the child may have.

When the party ordered to pay child support has a net monthly resource that is not greater than $8,550, the standard schedules for child support per Texas Family Code are as follows:

  • 1 child: 20% of obligor’s net resources
  • 2 children: 25% of obligor’s net resources
  • 3 children: 30% of obligor’s net resources
  • 4 children: 35% of obligor’s net resources
  • 5 children: 40% of obligor’s net resources
  • 6 or more children: no less than the support amount for 5 children

While a court-mandated child support order must be followed, there are also situations in which your child support order can be modified.
